International community must take action to oppose the 'new Cold War'

If recent developments in the three major areas of politics and diplomacy, international trade and economics, and military in the US are looked at together, there will be a chilling discovery. This week, the leaders of the US, Japan, and South Korea will hold a meeting at Camp David, a retreat of US presidents. This kind of summit is the first in the history of these three countries, and its target against China is no longer concealed. According to reports from Japanese media, Japan and the US will also agree this week to jointly develop an interceptor missile "to counter hypersonic warheads being developed by China, Russia and North Korea." As for the executive order on introducing investment restrictions on China recently signed by US President Joe Biden, its negative impacts are spreading and fermenting.

The actions and policy measures of the US mentioned above are all marked by a strong "new Cold War" color and exhibit a trend of continuity and escalating intensity. Can they be characterized as "new Cold War" thinking or actions? This can be discerned through the following four criteria. First, is it confrontational zero-sum competition or cooperative mutual benefit? Second, does it involve ideological delineation or equal exchange, mutual learning, and peaceful coexistence among different civilizations? Third, does it create cliques and alliances for confrontation or does it promote openness, inclusivity, and the construction of a community with a shared future for mankind? Fourth, does it resort to containment and suppression against perceived competitors, or does it engage in benign competition within the scope of international rules and principles? Upon comparison, the answer becomes self-evident.

Just as the drumbeats of the "new Cold War" are becoming more frequent and the smell of gunpowder more suffocating, prominent figures in the White House, including President Biden, have been emphasizing on various occasions that the US "does not seek a "new Cold War"," that "the US must reject neo-containment," and that "Washington should learn from the lessons of the Cold War and the old Cold War construct of blocs is not coherent." This has created a strange scene where there is not just a departure but even a contradiction between the actions and statements of the US, as well as between US self-assessment and the real impressions of the outside world about it. This issue goes beyond American hypocrisy or lack of self-awareness; it harbors a significant underlying risk.

There are at least two possibilities. The first one is that the US knows it is engaged in a "new Cold War" and is well aware that people all around the world, including Americans, strongly oppose and are deeply concerned about a "new Cold War." In other words, the US realizes that this is a highly risky undertaking and therefore would never admit to it. Instead, it might label its actions with a new term to deceive the world.

The second scenario is that the US has actually initiated a "new Cold War," but it does not really think that it is engaging in a "new Cold War." This will have more serious consequences than the first scenario, because the US not only refuses to make a reflection and change its course, but also will gain a stronger "moral drive" from self-hypnosis. In order to wake the US up from its pretended or genuine sleep, the international community needs to strengthen its resistance and criticism against the US' initiation of a "new Cold War" and take actions.

Regardless of what the US diplomatic strategists say or think, their actions speak louder. When faced with international challenges, especially when dealing with countries that have similar power with the US but different political and cultural backgrounds from the US, they habitually and unconsciously refer to the Cold War experience. They sometimes even directly resort to Cold War tactics, without taking off the "Cold War glasses" to view the world and era that have already undergone tremendous changes, even though they may also know that this is wrong and dangerous.

An article in the American magazine Foreign Affairs points out that Cold War history has become a straitjacket constraining how Americans perceive the world, including making Americans struggle to understand gray areas between friend and foe, making negotiations with rivals appear to carry impossibly high stakes and making it hard for Americans to imagine a less-militarized foreign policy.

The deeper the misunderstandings of history and reality, the stronger the limitations and misguidance of Cold War thinking on American foreign policy decision-makers. Binary thinking makes it impossible to understand the complexity and richness of a multipolar world, and severely lacks imagination for the future. The diplomatic strategies and approaches formulated based on this have distorted international politics.

More specifically, Washington has misunderstood history, misjudged the times, and misunderstood the Communist Party of China and the Chinese people. The destructive power of "new Cold War" is world-class, and the fate of all humanity stands at a crossroads. American political elites may believe that the US was the winner of the Cold War, which is controversial, but it is certain that the US cannot be the winner of the "new Cold War" and must bear historical responsibility for today's choices.

US succeeds in hypersonic missile test launch, technology China has long mastered

After a series of failures, the US Air Force on Monday announced that it has finally succeeded in the test launch of its air-launched hypersonic missile, a technology China has long mastered and even put on public display at a recent air show.  

The US’ scheme is to use the hypersonic missile and the recently revealed B-21 stealth bomber to penetrate China’s air defense, but the Chinese People’s Liberation Army (PLA) has what it takes to defend the country, experts said on Tuesday.

A full prototype of the Air-launched Rapid Response Weapon, also known as the AGM-183A missile, was launched from a B-52 bomber off the coast of California on Friday, and all of the objectives of the test were met, CNN reported on Monday, citing a statement from the US Air Force.

The AGM-183A is a boost-glide missile that uses a booster rocket to accelerate a projectile to hypersonic speeds, before a glide vehicle separates from the booster and uses inertia to travel to its target, CNN said.

The successful test launch of the missile came after a series of failures in testing last year, forcing the Air Force to delay the project at a time when China and Russia have shown advances in their own programs, CNN reported.

During the Airshow China 2022 held in Zhuhai, South China’s Guangdong Province in November, the PLA Air Force put on display an H-6K bomber which carried a type of missile  widely believed to be hypersonic.

China also displayed the DF-17 hypersonic boost-glide missile at the National Day military parade on October 1, 2019 in Beijing.

Russia’s Kinzhal hypersonic air-launched ballistic missile has also been reportedly deployed in combat in the Ukraine crisis.

With China and Russia taking the lead in hypersonic weapons development, the US is hurrying to build ones of its own, with the rush felt in several previous failures, a Chinese military expert who requested anonymity told the Global Times on Tuesday.

Compared with its Chinese and Russian counterparts, as well as air-breathing hypersonic missiles, the AGM-183A should not be considered very advanced, the expert said.

On December 2, the US Air Force’s next-generation stealth bomber, the B-21, made its public debut.. The US wants to use the low-end B-52 bomber which cannot penetrate air defense on its own to carry the strongly penetrative, standoff AGM-183A hypersonic missile, and use the high-end B-21 stealth bomber to drop inexpensive munitions within the opponent’s defense lines, Zhang Xuefeng, another Chinese military expert, told the Global Times.

Chinese military aviation expert Fu Qianshao told the Global Times that the AGM-183A can be intercepted before it is launched from the B-52, which is a large and slow target that can never be stealth.

Another option, which can also counter the B-21, is to attack bases and airfields where the bombers are deployed, Fu said.

China's New Law To Counter US, EU Sanctions May Also Block Covid-19 Origin Investigation 

 Deportation, denying entry and freezing assets among countermeasures to stop long-arm jurisdiction

Top lawmakers in China on Thursday voted to pass the highly expected Anti-Foreign Sanctions Law, providing a comprehensive legal basis for blocking illegal foreign sanctions and preventing Chinese individuals and entities from suffering the damage resulting from such illegal sanctions. The new law will also offer sufficient legal foundation for taking an equal position with the West by imposing necessary countermeasures, Chinese legal experts said.

The Standing Committee of the 13th National People's Congress (NPC) convened its 29th session on Monday in Beijing, which was scheduled to conclude on Thursday, and draft version of the anti-foreign sanctions law was put to review for the second time on Monday. According to the rules and procedures of the legislative body, the draft law in the agenda of the NPC Standing Committee meeting should generally be reviewed three times before being put to a vote. However, if there is consensus on all aspects of the draft law, it can be reviewed twice.

The highly expected law, which is considered an effective and strong legal tool to stop the long-arm jurisdiction of foreign countries, includes 16 articles, stipulating principles of punishment for violating the law, and major authorities in enforcing it. Relevant authorities under the State Council - China's cabinet - can directly or indirectly participate in formulating, deciding and enforcing a countermeasure list targeted at individuals and entities that have taken discriminatory measures against Chinese citizens and organizations under the pretext of their domestic laws.

Targeted groups of the countermeasure list can be expanded to their relatives, spouse, the organizations that are led by these targeting individuals or operated by them, according to the law, which lays out a number of measures, including refusing to issue visas or denying entry, deportation, freezing properties and restricting relevant transactions and cooperation.

If any organization or individual assists foreign countries to take discriminatory measures, Chinese citizens and organizations can file a lawsuit with the people's court in line with the law and to stop infringement as well as seek compensation for losses, according to the law.

China also has set up a working mechanism in responding to foreign sanctions, which also coordinates relevant work, including information sharing. And authorities such as the Chinese Foreign Ministry or the State Council or others are responsible for releasing the list of countermeasures, which could be suspended or changed if necessary.

When the Legislative Affairs Commission of the NPC Standing Committee gave the example about who would be placed on the target of China's Anti-Foreign Sanctions Law, the spokesperson of the commission said that certain Western countries, under the pretext of Tibet, Hong Kong, Taiwan and the South China Sea, together with the COVID-19 pandemic, interfere in China's internal affairs, which are bullying tactics by imposing the so-called sanctions on Chinese government officials, as well as individuals and entities from those countries with misdeeds, would face countermeasures, which is seen as "having a taste of their own medicine."

"The law precisely and effectively targets those who have taken unilateral sanctions in hurting China's interests, and this targeted group can be expanded to their relatives or organizations, which would have strong deterrent effect," Huo Zhengxin, a law professor at the China University of Political Science and Law, told the Global Times on Thursday.

And besides detailed countermeasures, the law grants authorities flexibility to choose which measures to use to hit back, especially when measures fit their needs, Huo said.

Legal experts believed that the Anti-Foreign Sanctions Law, the first of its kind in China, will provide strong legal support and guarantees for the country against unilateral and discriminatory measures imposed by foreign countries, will also have a deterrent effect in the face of Western-led hegemony and demonstrate the collective determination of Chinese decision-makers in safeguarding China's core interests.

Compared to the previous countermeasures issued by administrative institutions, the law underscores in a more comprehensive and systematic way the Chinese government's attitude on the legal aspect when it confronts US government that has abused sanctions or long-arm jurisdiction to severely damage China's sovereignty, security and development interests, some legal experts who took part in the consultation process for the law told the Global Times. The anti-foreign sanctions law will also enable China to strike a balance between countermeasures and negotiations in fixing divergences.

Necessary, timely move

The US government has been imposing sanctions on a growing number of Chinese entities such as high-tech firms Huawei and ZTE over the so-called national security risks, and sanctioned a number of senior Chinese officials under the US' so-called Xinjiang and Hong Kong bills last year. In the eyes of legal experts, these have become regular moves for the US government in implementing illegal sanctions and carrying out long-arm jurisdiction against China. The Anti-Foreign Sanctions Law has also become a timely response to those unilateral moves, which may prompt more countries to follow suit.

The latest legislative progress was also in line with the top legislature's annual work schedule, unveiled in March, which indicated that China will enhance legislation in foreign-related fields, when Li Zhanshu, chairman of the Standing Committee of the NPC, vowed to focus on moves against sanctions and interference and countering long-arm jurisdiction, as well as enriching the legal "toolbox" for coping with foreign-related challenges and preventing risks.

The law could have an influence in two fields - blocking illegal sanctions imposed by other countries and the damage brought about by those sanctions; and taking countermeasures against these sanctions, Tian Feilong, a legal expert at Beihang University in Beijing, told the Global Times on Thursday.

In response to the increasing unilateral moves made by the US government, Chinese authorities have also taken corresponding countermeasures since September 2020. For example, China's Ministry of Commerce (MOFCOM) unveiled the provisions of China's unreliable entity list, which has been viewed by some as a measure by Beijing to counter the US crackdown on Chinese companies. It also issued a new order on January 9 adopting necessary countermeasures against the unjustified extraterritorial application of foreign legislation.

China's Foreign Ministry also announced 11 rounds of countermeasures over Western countries' interference in China's internal affairs since last December such as Xinjiang and Hong Kong by sanctioning a number of NGOs, anti-China politicians, arms producers and entities, as well as lawmakers who helped spread lies about those matters.

"Previous sanctions are fragmented and without sufficient legal basis, and may incur negative feedback due to lack of sufficient legal basis. Now, we have complete legal basis, offering us the same position as the West in taking countermeasures," Tian said, noting that it will also help integrate previous resources and forms to make China's countermeasures against foreign sanctions more systematic, scientific and powerful.

Common practice

It's also common practice for some Western countries to formulate similar laws in blocking foreign sanctions or opposing foreign interference. For example, the blocking statute, adopted in 1996, is an important achievement of unified EU action to protect EU operators, whether individuals or companies, from the extraterritorial application of third country laws, according to the EU website.

And an updated version of the blocking statute was implemented in 2018 to mitigate their impact on the interests of EU companies doing legitimate business in Iran.

Russia also passed a law in June 2018to counter the unfriendly behavior of the US and other countries to protect the interests, security, sovereignty and territorial integrity, as well as the rights of its citizens immune to the unfriendly behavior of the US.

When asked whether the law would affect China's relations with foreign countries, Wang Wenbin, spokesperson of the Chinese Foreign Ministry, said at a routine press conference on Thursday that there is no need to worry about that.

"It's necessary for China to formulate the Anti-Foreign Sanctions Law, as the law provides a strong legal basis and support for China to counteract foreign discriminatory measures," Wang said.

The spokesperson of the Legislative Affairs Commission of the NPC Standing Committee also said the law won't have any impact on China's continuous opening-up regarding economic development, as it has come up with a series of measures to facilitate foreign investment.

The main purpose of China's Anti-Foreign Sanctions Law is to authorize Chinese administrative agencies and judicial institutions to implement sanctions, and if there's more demand in the practice, top authorities such as the State Council and the Supreme Court can issue corresponding detailed administrative regulations and judicial interpretations based on the authorization, and gradually refine a more specific legal system, Huo told the Global Times.

Some senior officials, such as Carrie Lam, chief executive of the Hong Kong Special Administrative Region, hailed the law. Lam said the law will give the US and other countries "a taste of their own medicine," because a number of central government and HKSAR government officials have been sanctioned by the US for the national security law for Hong Kong implemented in 2020.

"The HKSAR government lacked the resources to fight those sanctions in the past. With the implementation of the Anti-Foreign Sanctions law, they have the top authority's legal support on their backs," Tian said, noting that whether including the law into Annex III of the Basic Law or enabling the HKSAR government to revise or work on relevant anti-sanction local laws are both part of the consideration.

US President-elect Joe Biden to form pandemic task force


US President-elect Joe Biden has announced he will form a task force of scientists and experts to bring COVID-19 under control in the United States.

 US President-elect Joe Biden vowed to heal and unite the US, a process that will begin with naming a group of scientists and experts as transition advisers on Monday to deal with the COVID-19 pandemic, in a speech at a rally in his hometown of Wilmington, Delaware.

The COVID-19 task force plan will be built on bedrock science, and be constructed out of compassion, empathy, and concern, Biden said as he declared victory Saturday night at the rally.

"I will spare no effort, none, or any commitment to turn around this pandemic."

"Our work begins with getting COVID under control. We cannot repair our economy, restore our vitality or relish life's most precious moments... until we get it (coronavirus) under control," Biden said.

The President-elect said, "On Monday, I will name a group of leading scientists and experts as transition advisors to help take the Biden-Harris plan and convert it into an actual blueprint that will start on January 20, 2021."

The US President-elect said he wanted to provide "some comfort and solace" to the families of the 230,000 Americans who had died from COVID-19. In his speech, Biden also thanked local elected officials and volunteers who worked the polls in the middle of the pandemic.

The US has been hit hard by the pandemic, which has infected over 9 million and killed more than 236,000 Americans.

Biden also vowed to "restore the soul of America" and "rebuild the backbone" of the US. "Let this grim era of demonization in America begin to end here and now," Biden said.

The US President-elect pledged to be a president who seeks not to divide but unify. Addressing those who voted for President Trump, Biden said he understood their disappointment. "But now, let's give each other a chance," he said.

The former vice president said it was time to listen to each other again, and to make progress.
